A Critical Strategic Update

The Badge Archive is entering a period of significant restructuring. To ensure the long-term survival and legal standing of this resource, we are beginning an audit and update of our entire database.

Project Scope and Impact on Other Projects

This is a high-priority, multi-month undertaking. Due to the scale of this project, most other secondary projects are being placed on hold. Our team continues to work on scouting projects with our own scouts but there are no guaranteed release dates for anything at this point. The primary focus is the completion of this update to protect the archive’s ability to exist as a permanent resource.

Why We Are Removing Official Badge Hotlinks

You may notice we no longer display the official badge images on any of our updated post pages. While we strive to be the most comprehensive resource for scout leaders, we are now making the decision to transition away from “hotlinking” (embedding) official images.

We previously believed that because we were not copying the image files onto our own server, we were following copyright laws. This concept is often referred to as the “Server Test.” Historically, some courts (notably the 9th Circuit) ruled that if a website does not host the file on its own server, it is not “copying” or “displaying” the work in a way that infringes copyright.

More recent rulings (especially in the New York 2nd Circuit) have explicitly rejected this. These courts have stated that displaying an image on your page (regardless of where the file is physically stored) violates the copyright holder’s exclusive right to publicly display their work.

If we hotlink a copyrighted image without explicit permission, we are potentially infringing on those display rights. Furthermore, the original host (GSUSA) can technically “break” the link or replace it with a “Stop Stealing Bandwidth” image at any time, which creates a poor experience for our users.

Lessons from the “Country Facts” Experience

This decision follows a deep dive we took after a separate experience regarding educational materials. We discovered that summarizing country facts based on information from sources like Britannica or National Geographic could lead to Terms of Use violations, even if we had a paid subscription. We could only use information from printed books we owned or public open sources like the CIA World Book.

We realized that “legal” doesn’t just mean following copyright. It also means respecting the specific terms of service of the organizations we reference. This prompted us to start an audit everything on The Badge Archive to ensure we are 100% compliant.

Our Transition Plan

It will take us a while to make the full shift for this method, going level by level and organization by organization. However, we have already started a project to change our static pages into posts to help with site organization. We are simply adding this copyright compliance step to that existing redesign process.

Our Commitment to You

Our mission is to keep The Badge Archive available as a free resource for all scout leaders. To protect the longevity of this site, we have shifted our strategy:

  1. We are created our own “inspired-by” illustrations to represent badge themes.
  2. We wrote our own requirement summaries based on the activities suggested and the official requirements, rather than copying official requirement texts.
  3. Instead of hotlinking images, we are providing a direct text button to the official scout shop. This ensures you can always see the official product at the source while we remain a safe, independent historical archive.

By making these changes, we ensure that The Badge Archive remains a stable, legal, and permanent home for scouting history and resources.
